পশ্চিমবঙ্গের প্রায় সকল সরকারি প্রতিষ্ঠানে নিয়োগ দুর্নীতির শুনানি নিয়ে Abhijit Gangopadhyay অনেক গুরুত্বপূর্ণ সিদ্ধান্ত নিয়েছেন। SSC থেকে শুরু করে প্রাথমিক TET, এছাড়াও কিছু দিন আগে রাজ্যের বেশ কয়েকটি পৌরসভায় নিয়োগ দুর্নীতির অভিযোগ প্রকাশ্যে এসেছে এবং এই সকল দুর্নীতির সঠিক তদন্ত পাওয়ার আশায় সকল যোগ্য চাকরি প্রার্থীদের একমাত্র ভরসা হল আদালত। এতদিন যাবত এই সকল নিয়োগ দুর্নীতির মামলা নিয়ে অনেক কড়া সিদ্ধান্ত ঘোষণা করেছিলেন বিচারপতি অভিজিৎ গঙ্গোপাধ্যায়। বিশেষ করে ২০১৬ সালে ৪৩ হাজার প্রাথমিক শিক্ষকদের নিয়োগের মামলা।

এই সকল বিষয়ের জন্যই যোগ্য চাকরিপ্রার্থীরা বিচারপতি Abhijit Gangopadhyay এজলাসে মামলার শুনানি হোক সেটাই চাইতেন (WB Recruitment Scam). কিন্তু সম্প্রতি সুপ্রিম কোর্টের প্রধান বিচারপতির ডিভিশন বেঞ্চে এক মামলা চলাকালীন বলা হয়েছে, কোন বিচারপতি যেই মামলা নিয়ে শুনানি করছেন, তিনি সেই বিষয় নিয়ে কোন রকম মন্তব্য বা সাক্ষাৎকার দিতে পারেন না এবং তিনি এই কাজ করলে তাকে সেই মামলার শুনানির অধিকার থেকে সরিয়ে দেওয়ার প্রয়োজন।
কিন্তু এই মন্তব্যের কারণ কি? সুপ্রিম কোর্টের প্রধান বিচারপতি ডি ওয়াই চন্দ্রচূড় জানিয়েছেন – আমরা কোন মামলায় (WB Recruitment Scam) হস্তক্ষেপ করতে চাইনা। কিন্তু যদি কোন বিচারপতি (Abhijit Gangopadhyay) কোন মামলার শুনানি বা মামলাকারীর বিষয়ে টেলিভিশন চ্যানেলে নিজের মন্তব্য জানান তাহলে তিনি সেই মামলার আর শুনানি করতে পারেন না। আমাদের এই ধরণের কারণের জন্য এই সকল মামলায় হস্তক্ষেপ করতে হয়, এই প্রক্রিয়া একদমই ঠিক নয়।
WB Recruitment Scam সহ আরও সকল প্রকারের দুর্নীতি নিয়ে এক বেসরকারি চ্যানেলে সাক্ষাৎকার দিয়েছিলেন বিচারপতি Abhijit Gangopadhyay। তিনি সত্যিই এই সাক্ষাৎকার দিয়েছিলেন কিনা এই নিয়ে হাইকোর্টের রেজিস্টার জেনারেলকে আগামী শুক্রবারের মধ্যে জানাতে বলে হয়েছে। এই কথা প্রমানিত হয়ে গেলে অভিজিৎ গাঙ্গুলিকে WB Recruitment Scam এর সকল মামলা থেকে সরিয়ে দেওয়া হতে পারে বলে মনে করছেন অনেকে। এইবার দেখার অপেক্ষা যে সুপ্রিম কোর্ট কি সিদ্ধান্ত গ্রহণ করতে চলেছে।
১৯৮৫ সালে বিচারপতিদের জন্য ব্যাঙ্গালোর প্রটোকল (THE BANGALORE PRINCIPLES OF JUDICIAL CONDUCT) নামে একটি আইন আনা হয়। যেখানে কোনও মামলার বিচার চলাকালীন সেই বিচারপতি উক্ত মামলা নিয়ে সংবাদ মাধ্যমে কোন বিবৃতি দিতে পারবেন না। আর সেই প্রটোকল কে হাতিয়ার করে সুপ্রীম কোর্টে মামলা হয়েছে। আর সেই মামলায় সুপ্রীম কোর্টের বিচারপতি জাস্টিস ডি ওয়াই চন্দ্রচূড় রাজ্যের রেজিস্টার জেনারেল কে বিষয়টি খতিয়ে দেখার নির্দেশ দেন। যেখানে ব্যাঙ্গালোর প্রটোকল অনুযায়ী তাঁর বিচারাধীন সকল মামলা থেকে সরানো হতে পারে।
রাজ্যের সকল নিয়োগ দুর্নীতি মামলা (WB Recruitment Scam) নিয়ে Abhijit Gangopadhyay কিছু দিন আগে জানিয়েছিলেন আমাদের কাছে এমন প্রমাণ আছে যার মাধ্যমে ২০১৬ সালের পুরো প্যানেল আমরা বাতিল করে দিতে পারি কিন্তু আদালত চায়না কোন যোগ্য প্রার্থীর চাকরি যাক। এছাড়াও SSC মামলায় দুর্নীতি প্রমাণ হওয়ার জন্য ২০০ এর বেশি শিক্ষকদের চাকরি বাতিলের ঘোষণা করা হয়েছিল। কিন্তু সুপ্রিম কোর্টের তরফেও এই সিদ্ধান্ত স্থগিত করা হয়েছিল। এছাড়াও আরও অনেক নিয়োগ দুর্নীতির মামলার শুনানিতে গুরুত্বপূর্ণ ভূমিকা পালন করছেন Abhijit Gangopadhyay সেই সকল মামলার ভবিষ্যৎ নিয়ে চিন্তায় সকলে।

সত্যের জয় চিরকাল হয়। তাই সত্য ও সঠিক পথে যদি বিচারপতি অভিজিৎ গাঙ্গুলী থেকে থাকেন তাহলে হয়তো ক্ষনিকের জন্য অসৎ ও অসত্যের মেল বন্ধনে সত্যকেও কখনো কখনো এক পা পিছিয়ে যেতে হয়। কিন্তু আখেরে জয় সত্যেরই হয়। বিচারপতি গাঙ্গুলীও যে সঠিক ও সত্যের একজন প্রতিনিধি তা আজ নয় কাল সগর্বে প্রকাশিত হবেই হবে। সেদিন সমস্বরে সবাই বলবে বিচারপতি গাঙ্গুলীই একমাত্র ঠিক ছিলেন বাকি সবাই ছিল ভুল।

Justice Ganguly এখনো পর্যন্ত যে রায় দিয়েছেন তাতে সমাজের সুদূরপ্রসারী ক্ষতি অনেকাংশেই বন্ধ বা কমে যাবে। এবং সে বিষয়ে মিডিয়াতে সাক্ষাত্কার দিয়ে যদি আইনগতভাবে সামান্য বিচ্যুতি করে ফেলেন তাহলে সেটা সতর্ক করেই শেষ করলে সমাজের সব স্তরের মানুষের ভালো হত। যদি Justice Ganguly কে সরিয়ে দেওয়া হয় তাহলে এসব অনিয়ম বেনিয়মের সংগে যারা যুক্ত তারা সবাই আনন্দিত হবে ও ভবিষ্যতে আবার এই কুকর্মে উত্সাহিত হবে। মানুষের কল্যাণে ওনার মতো সাহসী, নির্ভীক বিচারপতির এই দুর্নীতির বিচার করতে দেওয়া হবে এটাই আশা রাখি সর্বোচ্চ আদালতের কাছে। তাতেই সত্যের জয় হবে।
This is inevitable. We know that our polity and constitution has 3 pillars… legislature, executive and judiciary. But right now legislature is the only pillar whereas the other 2 has already been subdued by it. Our CJI, Mr. Chandrachur will now harras Justice Ganguly upto that point when he will automatically withdraw himself into a shell of utter frustration. CJI has no option as Justice Ganguly has tried to revive judiciary to reclaim its actual position and glory.

Why do a seating justice need to appear in TV channels at the first place?
He should have been content of doing his job with utmost integrity inside his courtroom.
The journalist could do what he did because our justice did lend himself to be trapped at the first place by agreeing to that said interview.

Great that judicial process is taking appropriate step, a bit of late. Merit of any case is not questioned. Basic question and rule of natural justice deservedly demand that process of law start with affidavit and counter affidavit. Making passed of any order just on submission of one party affidavit without asking for counter affidavit of opposite party is devoid of any legal process, and if it is allowed to continue then money power will put common people in undue trouble by approaching judiciary with their affidavit & ample scope will be open to render undue torture mainly on honest poor people.
Any respectable justice Must Strictly Adhere to rules or protocol of judiciary. Making comment, wrong or right in TV on the on going cases under his/her bench is reportedly violation of judicial protocol/rule. No one is above law. So this appears to be a very clear case of obvious nature …should be welcome by sensible citizens.
Last few month corruption related problems enlightened and people of west bengal are hesitating to know the name of the culprits. Justice now a days are not so important as it is very costly. It is rather than better to satisfy ourselves with the value of our common scence. Culprits are so claver that they will defeat ourselves again and again. Present scenario is linked with the past and past criminals trying to produce themselves as clean but they are also responsible for past circumstances. Hence it is the question how to solve the problems and to find out the real path honest and sincere non political persons should come out to handle this situation. It can not be that young generation will stand in the road year after year and political leaders will eat the cream from them.

I appreciate every bit of Mr Chakraborty’s Comments.However I failed to understand the question posed by him in conclusion as to why Suman laid a tricky trap to compel Justice to make a mistake as this.
He added that the reason being ,media is a puppet being made to dance to the tune of judiciary.
Is he trying to imply that judiciary is interested in subverting the excellent job being done by Justice Abhijit Ganguly?
Extending this further,do we surmise that Judiciary in turn is being manipulated by the politicians who were being exposed by Justice Ganguly?
